These Terms apply to anyone who uploads, posts, streams, records, distributes, or monetizes content through FanPulse. They supplement the Terms of Use.
1. Creator Eligibility and Account Information
You must meet the age and identity requirements shown for each creator feature. Payout and monetization features require an adult or legally authorized entity, completed tax and payment onboarding, and compliance with applicable sanctions and financial controls.
You must provide accurate creator, ownership, contact, payout, and rights information. FanPulse may require identity verification, business documents, releases, source files, or proof of licenses.
2. Ownership and License to FanPulse
You retain ownership of Creator Content you own. By submitting Creator Content, you grant FanPulse a worldwide, nonexclusive, royalty free, sublicensable, transferable license to host, store, reproduce, transcode, encode, adapt for technical formats, distribute, transmit, display, perform, communicate to the public, make available, index, moderate, caption, translate, create thumbnails and previews from, clip, and promote the content in connection with operating, improving, securing, marketing, and distributing FanPulse.
This license allows FanPulse to make the content available through websites, applications, connected devices, embeds, notifications, search, social previews, creator pages, game rooms, and authorized distribution partners. FanPulse may use your channel name, handle, profile image, voice, and likeness to identify and promote the content and your FanPulse presence.
The license continues while content is available and for a reasonable period afterward for backups, legal records, security, dispute resolution, cached copies, clips already created under your settings, and content already shared or embedded by users. FanPulse will not use Creator Content in unrelated third party advertising as a creator endorsement without separate permission, except for ordinary promotion of FanPulse and the content as described above.
3. Creator Representations
You represent and warrant that:
- You own the content or have all necessary copyright, music, trademark, publicity, privacy, performance, synchronization, mechanical, broadcast, data, and other rights.
- You have valid releases from guests, cohosts, callers, performers, and people prominently featured where required.
- The content does not violate law, platform rules, confidentiality, sports integrity obligations, or another agreement.
- You will not transmit unlicensed sports broadcasts, game audio, venue feeds, subscription streams, or protected data feeds.
- Your title, thumbnail, tags, sponsorship label, and description are not misleading.
- Analytics, audience, and monetization information you submit are accurate.
- The content does not contain malware, hidden tracking, or code intended to interfere with FanPulse.
4. Livestream Requirements
For every live session:
- Use only original commentary and properly licensed content.
- Keep protected game screens, radio calls, broadcast audio, and subscription streams out of the capture.
- Inform guests that the session may be live, recorded, clipped, moderated, and replayed.
- Use appropriate category, age, content, sponsorship, and wagering labels.
- Maintain reasonable moderation for chat and guests.
- Follow any event, credential, venue, team, league, school, or media access restrictions.
- Do not display credentials, private dashboards, confidential communications, or personal data.
- End or delay the stream when required for safety, privacy, rights, or sports integrity.
FanPulse may insert platform notices, captions, safety messages, advertising, sponsorship labels, or technical overlays into a stream where permitted by the applicable monetization terms.
5. Music and Other Media
A subscription to a consumer music service does not normally grant commercial streaming rights. Use music, clips, sound effects, images, articles, graphics, and footage only when you have rights covering livestreaming, on demand replay, clipping, and commercial use.
FanPulse may mute audio, remove a replay, disable clips, or restrict monetization when a rights issue is detected. FanPulse does not obtain licenses on your behalf unless it expressly states otherwise.
6. AI and Synthetic Media
You must not clone a person's voice or likeness, fabricate a statement, create a deceptive synthetic event, or imply a real person's endorsement without authorization. Materially synthetic content must be disclosed when required by law, platform rules, or FanPulse instructions.
You may not use AI to fabricate game footage, score evidence, injury information, creator analytics, testimonials, or proof of ownership. FanPulse may require provenance information or source files for high risk media.
7. Sponsorships and Commercial Content
You are responsible for clearly disclosing sponsorships, free products, affiliate compensation, revenue share, and other material connections. FanPulse may require specific labels or disclosures and may place a platform label on commercial content.
Do not insert third party advertising, affiliate links, tracking pixels, overlays, or product placements into FanPulse content if they conflict with a FanPulse campaign, violate law, create security risk, or are prohibited by creator monetization rules.
8. Monetization and Payouts
Eligibility for tips, subscriptions, ad revenue, affiliate revenue, bonuses, or other monetization is not guaranteed. Compensation is governed by the specific monetization, campaign, or payout terms presented to you.
FanPulse may hold, reverse, or offset amounts associated with refunds, chargebacks, fraud, rights claims, fake engagement, inaccurate identity or tax information, prohibited content, or payment processor restrictions. FanPulse will provide an itemized explanation when reasonably possible.
Creators are responsible for taxes and for completing required payment and tax documentation. FanPulse may report payments and withhold amounts when required by law.
9. Moderation, Removal, and Preservation
FanPulse may review live or recorded content using automated systems and human reviewers. FanPulse may interrupt a stream, mute audio, disable chat, remove a replay, block a clip, limit distribution, suspend monetization, preserve a copy, or report content when reasonably necessary.
Removing content from public view does not require FanPulse to delete evidence needed for rights claims, safety, fraud, payment, legal, or regulatory purposes.
10. Creator Suspension and Termination
FanPulse may suspend or terminate creator features for repeated or serious violations, rights claims, fraud, unsafe conduct, sanctions, payment restrictions, or material brand and user safety risk. Except for urgent cases, FanPulse will provide a general reason and appeal method.
Upon termination, you must stop using creator badges, monetization claims, and restricted FanPulse assets. Earned and undisputed amounts remain payable subject to lawful adjustments and holds.
11. No Employment or Agency
Unless a separate signed agreement states otherwise, creators are independent users and are not FanPulse employees, agents, partners, or representatives. Creators control their content, schedule, equipment, and methods and may use other platforms.
12. Additional Terms for Featured or Contracted Creators
A featured creator, ambassador, sponsored creator, or production partner may be subject to a separate Campaign Order or creator agreement covering deliverables, exclusivity, usage rights, approvals, insurance, payment, and termination. That agreement controls over these Terms for the contracted activity.
