These Terms of Use, together with the documents incorporated below, govern access to and use of FanPulse websites, mobile applications, connected applications, live game rooms, creator channels, audio and video features, social feeds, chats, profiles, scoreboards, visual game presentations, stores, subscriptions, and related services. The services are provided by Alliable Interactive LLC, a Texas limited liability company doing business as FanPulse ("FanPulse," "Company," "we," "us," or "our").
1. Acceptance and Incorporated Terms
By creating an account, clicking an acceptance box, purchasing a subscription, uploading content, starting a livestream, or otherwise using FanPulse, you agree to these Terms and the following incorporated documents, as applicable:
- FanPulse Privacy Policy.
- Cookie Notice.
- Community Guidelines and Acceptable Use Policy.
- Creator, Livestream, and User Content Terms if you upload, stream, publish, or monetize content.
- Subscription, Billing, Cancellation, and Refund Terms if you purchase a paid service.
- Responsible Gaming, Sports Information, and Odds Disclaimer.
- DMCA Copyright Policy.
- SMS and Mobile Messaging Terms if you enroll in text messaging.
- Any promotion, contest, campaign, event, marketplace, or feature specific terms presented to you.
If a feature specific agreement conflicts with these Terms, the feature specific agreement controls for that feature. A negotiated written agreement signed by FanPulse controls over online terms only to the extent it expressly states that it does.
2. Eligibility and Age
You must be at least thirteen years old to create a general FanPulse account. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and is responsible for your use of FanPulse.
FanPulse is not directed to children under thirteen. Do not create an account or provide personal information if you are under thirteen. FanPulse may use reasonable age assurance measures and may suspend or delete an account when age information is inaccurate or required consent is missing.
You must be at least eighteen to purchase a subscription, receive creator payouts, enter a contract, or use another feature designated for adults. You must be at least twenty-one to access or create content that FanPulse designates as wagering related, and you must be located in a jurisdiction where the activity is lawful.
3. Account Registration and Security
You agree to provide accurate, current, and complete information and to keep it updated. You may not impersonate another person, create an account for someone without authority, sell or transfer an account, or use another person's credentials.
You are responsible for activity occurring through your account until you notify FanPulse of unauthorized access. Use a unique password, enable available security controls, and promptly report suspected compromise to [email protected]. FanPulse may require identity, age, payment, or account verification before restoring access or providing sensitive account information.
4. Description of FanPulse
FanPulse is a sports community and content platform. Depending on the features available, users may view scores and statistics, participate in game rooms, follow creators, post content, join chats, listen to or watch creator commentary, use interactive visualizations, purchase subscriptions or merchandise, and receive advertising or sponsored content.
Unless FanPulse expressly identifies a licensed broadcast, FanPulse is not the official broadcaster of a sporting event and does not grant users permission to rebroadcast television, radio, streaming, league, team, or venue content. Creator commentary, watch parties, field visualizations, and score presentations do not include third party broadcast rights unless FanPulse expressly states otherwise.
Features may change, be discontinued, become paid, or be limited by device, territory, age, rights availability, safety, or law. FanPulse does not guarantee that a feature, event, creator, stream, score source, or advertisement will remain available.
5. License to Use the Services
Subject to these Terms, FanPulse grants you a personal, limited, revocable, nonexclusive, nontransferable license to access and use the services for lawful personal purposes. This license does not permit you to:
- Copy, sell, sublicense, distribute, or commercially exploit the services except through an authorized FanPulse program.
- Scrape, harvest, crawl, index, mirror, frame, or extract data at scale without written permission.
- Reverse engineer, decompile, bypass, probe, or interfere with technical protections, rate limits, access controls, or security.
- Use FanPulse data to train, fine tune, benchmark, or supply an artificial intelligence model without written permission.
- Use scores, odds, visualizations, feeds, or account data to operate a competing service, unauthorized wagering product, data resale service, or automated decision product.
- Remove copyright, trademark, sponsorship, advertising, or rights notices.
FanPulse and its licensors retain all rights not expressly granted.
6. User Content and Creator Content
"User Content" includes posts, comments, messages, reactions, profile information, images, audio, video, livestreams, recordings, predictions, polls, data, links, files, and other material submitted or transmitted by a user.
You retain ownership of User Content you own. By submitting User Content, you grant FanPulse the rights stated in the Creator, Livestream, and User Content Terms. You represent that you own the content or have all rights, permissions, releases, and licenses required to submit it and permit FanPulse to operate the service.
FanPulse does not endorse User Content. Users and creators speak for themselves. FanPulse may label, rank, recommend, restrict, remove, preserve, or disclose User Content as described in these Terms, the Community Guidelines, and applicable law.
7. Live Audio, Video, Game Rooms, and Watch Parties
When using live features, you agree that:
- You will not restream or capture a game broadcast, subscription stream, radio call, venue feed, league feed, or other protected transmission without documented rights.
- You may provide original commentary, analysis, discussion, reaction, and lawful visual elements, but you must not use protected footage, audio, graphics, music, or real time data feeds without permission.
- You will obtain consent from guests, callers, cohosts, and people whose voice, likeness, or personal information you transmit.
- You will comply with recording and wiretap laws that apply to the participants and location.
- You will not solicit or disclose confidential injury, lineup, officiating, playbook, team, athlete, or integrity information.
- You will use delay, moderation, age gates, labels, and other safety controls required by FanPulse.
- FanPulse may interrupt or end a live session immediately for safety, rights, security, legal, or technical reasons.
Live content may be recorded, clipped, transcribed, captioned, translated, moderated, and made available for replay according to your settings and the Creator Terms.
8. Community Conduct
You must follow the Community Guidelines. Prohibited activity includes unlawful content, threats, harassment, hate, doxxing, sexual exploitation, nonconsensual intimate material, dangerous conduct, fraud, scams, impersonation, deceptive synthetic media, spam, fake engagement, unauthorized advertising, infringement, malware, account manipulation, match fixing, misuse of confidential sports information, and evasion of enforcement controls.
FanPulse may consider conduct occurring outside FanPulse when it creates a credible risk to users, creators, sports integrity, legal compliance, or the safe operation of FanPulse.
9. Moderation and Enforcement
FanPulse may use automated systems and human review to detect and address violations. FanPulse may issue a warning, limit visibility, remove content, disable monetization, restrict features, suspend or terminate an account, preserve evidence, refer a matter to a platform, rights holder, sports organization, regulator, or law enforcement agency, or take another reasonable action.
Except where urgent action is required, FanPulse will use reasonable efforts to provide a general reason for a significant account restriction and a method to appeal. FanPulse is not required to disclose confidential security methods, reporter identities, trade secrets, or information that could enable evasion or endanger another person.
No moderation system is perfect. FanPulse is not obligated to monitor all content and does not guarantee that objectionable or unlawful content will be identified immediately.
10. Copyright, Trademarks, and Publicity Rights
You may not upload or use content that infringes copyright, trademark, publicity, privacy, or other rights. FanPulse responds to qualifying copyright notices under the DMCA Copyright Policy and may terminate repeat infringers.
League, team, school, athlete, event, broadcaster, sponsor, and other names and marks belong to their respective owners. Descriptive reference to a team or event does not imply endorsement. Do not use a logo, uniform, broadcast clip, photograph, music recording, or likeness commercially without required permission.
FanPulse names, logos, product names, interfaces, and designs are Company property. These Terms do not grant a right to use FanPulse branding outside ordinary identification of the service.
11. Sports Data, Scores, Visualizations, and Alerts
Scores, schedules, rosters, injuries, statistics, odds, field positions, race positions, visualizations, notifications, and similar information may be delayed, incomplete, estimated, corrected, or supplied by third parties. FanPulse does not guarantee accuracy, timeliness, completeness, or suitability for wagering, fantasy contests, financial decisions, officiating, scouting, emergency response, or any other high consequence purpose.
A field, court, track, pitch, strike zone, possession, or play animation is an informational visualization and may not represent the exact event location or official ruling. The official league, team, venue, operator, or governing body source controls where applicable.
12. Wagering and Fantasy Content
FanPulse does not accept, book, place, or settle wagers unless a separately licensed service is expressly identified. General FanPulse content is for information and entertainment. Predictions, picks, rankings, opinions, lines, odds, and statistics do not guarantee an outcome or profit.
You are responsible for knowing and following the laws where you are located. Do not use FanPulse to place or facilitate an unlawful wager, target a prohibited person, use inside information, manipulate a contest, harass an athlete or official, or evade a self exclusion or age control. Additional rules appear in the Responsible Gaming, Sports Information, and Odds Disclaimer.
13. Advertising, Sponsored Content, and Third Party Links
FanPulse may display ads, sponsored placements, affiliate links, promoted creators, branded game rooms, and commerce links. Paid placements should be identified with labels such as "Ad," "Sponsored," or "Promoted." Advertising does not necessarily reflect FanPulse's editorial view or endorsement.
Third party products, websites, creators, stores, and services are controlled by their providers. FanPulse is not responsible for third party terms, content, security, availability, claims, transactions, or privacy practices. Review third party terms before interacting or purchasing.
14. Subscriptions, Purchases, and Virtual Items
Paid subscriptions, trials, merchandise, event access, tips, virtual items, and other purchases are governed by the terms displayed at checkout and the Subscription, Billing, Cancellation, and Refund Terms. Prices may include or exclude taxes as disclosed. App store purchases may also be governed by the app store's billing and refund rules.
Virtual items, badges, reactions, or credits are licensed, not sold, have no cash value unless FanPulse expressly states otherwise, and may not be transferred or redeemed outside the service. FanPulse may modify or discontinue virtual items subject to applicable law.
15. Feedback
If you provide an idea, suggestion, or feedback, you grant FanPulse a perpetual, worldwide, royalty free right to use it without restriction or compensation. This does not transfer ownership of your User Content or confidential information accepted under a separate written agreement.
16. Privacy and Communications
The FanPulse Privacy Policy explains how personal data is handled. By using the service, you acknowledge the practices described there.
FanPulse may send transactional communications about security, billing, moderation, legal notices, and service changes. Marketing email and text messages are subject to applicable consent and opt out rules. Withdrawing marketing consent does not stop necessary transactional messages.
17. Suspension and Termination by You
You may stop using FanPulse at any time and may request account deletion through available settings or [email protected]. Deletion may not immediately remove content already shared by others, incorporated into a live recording, retained in backups, or kept for legal, fraud, safety, payment, tax, or rights purposes.
Canceling an account does not automatically cancel a subscription billed through a separate app store or payment provider. Follow the cancellation instructions shown for that purchase.
18. Suspension and Termination by FanPulse
FanPulse may suspend, restrict, or terminate access when reasonably necessary to enforce these Terms, protect users, preserve rights, prevent fraud, comply with law, respond to payment failure, address security, or discontinue a service. Where reasonable, FanPulse will provide notice and an appeal method.
Upon termination, your license to use FanPulse ends. Provisions concerning ownership, content licenses, payments, disclaimers, indemnification, liability limits, disputes, and records survive as needed to give them effect.
19. Disclaimers
To the maximum extent permitted by law, FanPulse, its content, sports data, creator content, live features, visualizations, stores, advertisements, links, and services are provided "as is" and "as available." FanPulse disclaims implied warranties of merchantability, fitness for a particular purpose, title, noninterference, and noninfringement.
FanPulse does not warrant that the service will be uninterrupted, secure, error free, accurate, or free of harmful components. FanPulse does not guarantee creator availability, sports outcomes, earnings, audience growth, subscription savings, wagering results, or that content will remain available.
Some jurisdictions do not permit certain disclaimers, so these disclaimers apply only to the extent permitted by law.
20. Limitation of Liability
To the maximum extent permitted by law, FanPulse and its affiliates, members, managers, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, lost revenue, lost data, loss of goodwill, or business interruption.
Except for liability that cannot legally be limited, FanPulse's total liability arising from or relating to the service or these Terms will not exceed the greater of one hundred U.S. dollars or the amount you paid FanPulse for the service during the six months before the event giving rise to the claim.
This limitation does not reduce a refund or payment expressly required by law and does not apply to FanPulse's fraud or willful misconduct where applicable law prohibits limitation.
21. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless FanPulse and its affiliates, members, managers, officers, employees, contractors, and agents from third party claims, damages, penalties, costs, and reasonable attorneys' fees arising from your User Content, your conduct, your violation of these Terms, or your infringement or violation of another person's rights.
FanPulse will provide reasonable notice and may control the defense. You may not settle a claim in a way that admits wrongdoing by or imposes nonmonetary obligations on FanPulse without written consent.
22. Dispute Resolution and Arbitration
22.1 Informal Notice. Before filing a claim, the complaining party must send a written Notice of Dispute describing the facts, legal basis, requested relief, and contact information. Send notices to [email protected] and [company postal address — attorney to complete]. The parties will attempt in good faith to resolve the dispute for thirty days.
22.2 Individual Arbitration. Except for the matters in Section 22.4, an unresolved dispute arising from these Terms or FanPulse will be resolved by binding individual arbitration administered by the American Arbitration Association under the rules applicable to the dispute. If the Consumer Arbitration Rules apply, those rules control. The Federal Arbitration Act governs this section. A hearing may occur by video unless the arbitrator determines an in person hearing is necessary. The arbitrator may award the same individual relief a court could award.
22.3 Class and Representative Action Waiver. Claims may be brought only in an individual capacity. Neither party may bring or participate in a class, collective, coordinated, consolidated, mass, or representative proceeding, except for a nonwaivable public injunctive relief claim where applicable law requires court treatment. If a portion of this waiver is unenforceable for a claim, only that claim will proceed in court.
22.4 Exceptions. Either party may bring an eligible individual claim in small claims court, seek temporary injunctive relief to protect intellectual property, confidentiality, security, user safety, or sports integrity, report a matter to a government agency, or pursue a remedy that cannot legally be arbitrated.
22.5 Consumer Fees. For a qualifying individual consumer claim, FanPulse will pay arbitration fees that exceed the amount the consumer would pay to file the claim in a court of competent jurisdiction, unless the arbitrator determines the claim is frivolous or brought for an improper purpose.
22.6 Arbitration Opt Out. You may opt out of arbitration by sending a signed notice to [email protected] within thirty days after first accepting these Terms. Include your legal name, account email, mailing address, and a clear statement that you opt out of arbitration. Opting out does not affect your right to use FanPulse.
22.7 Governing Law and Court Venue. Texas law governs, except that the Federal Arbitration Act governs arbitration. For claims not subject to arbitration, exclusive venue lies in state or federal courts located in Harris County, Texas, unless consumer law requires another venue. Each party waives trial by jury to the extent permitted by law.
22.8 Time to Bring Claims. A claim must be filed within one year after it accrues, except where applicable law requires a longer period.
23. Changes to These Terms
FanPulse may update these Terms prospectively. For a material change to arbitration, content rights, automatic renewal, privacy, or user payment obligations, FanPulse will provide advance notice and seek renewed acceptance when required. Changes do not retroactively reduce a vested payment right or remove a refund required by law.
Your continued use after the effective date of a nonmaterial change constitutes acceptance. If you reject a change, stop using the affected service and cancel any future renewal before the next billing date.
24. General Provisions
These Terms and incorporated documents are the entire agreement for ordinary use of FanPulse. You may not assign them without consent. FanPulse may assign them in connection with a merger, financing, reorganization, or sale. Delay in enforcement is not a waiver. If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed. Headings are for convenience. These Terms do not create third party beneficiary rights except for indemnified parties.
