This Privacy Policy describes how Alliable Interactive LLC d/b/a FanPulse collects, uses, discloses, and retains personal data when people use FanPulse websites, applications, profiles, feeds, chats, live features, creator channels, subscriptions, stores, events, and related services.
1. Scope and Roles
This Policy applies when FanPulse determines the purposes and means of processing personal data. A third party website, app store, advertiser, payment provider, creator business, or linked service may process data under its own policy. The Ambassador Privacy Notice applies to Ambassador Program applicants and participants. An employee or contractor privacy notice may apply to workforce data.
2. Information We Collect
2.1 Information You Provide.
- Account information, including name, username, password, email, phone number, birth date or age range, and region.
- Profile information, including avatar, biography, favorite teams, leagues, sports, creators, and interests.
- User Content, including posts, comments, messages, reactions, polls, predictions, images, audio, video, livestreams, recordings, captions, and files.
- Creator information, including channel data, content schedules, rights documentation, releases, audience analytics, payout onboarding status, and tax status indicators.
- Purchase information, including products, plans, transaction history, billing address, and limited payment status. Full payment card information is handled by the payment processor rather than stored by FanPulse when reasonably possible.
- Communications, reports, appeals, surveys, support requests, and promotion entries.
- Information from contacts or address books only if you intentionally use a feature requiring that access and grant device permission.
- Location information if you enable a location based feature. FanPulse requests precise location only when necessary and explains the feature purpose at collection.
2.2 Information Collected Automatically.
- Device, browser, app version, operating system, language, time zone, and identifiers.
- IP address, approximate location, network information, login records, security events, and authentication data.
- Usage activity, including pages, feeds, game rooms, creators, teams, searches, clicks, watch and listen time, playback position, reactions, reports, and feature interactions.
- Advertising and attribution information, including campaign identifiers, ad impressions, ad clicks, referral links, first party cookies, and conversion events.
- Content and safety signals, including spam indicators, duplicate accounts, device relationships, moderation events, audio or image matching, and suspicious behavior.
- Crash, performance, diagnostics, and service logs.
2.3 Information from Other Sources. FanPulse may receive information from login providers, app stores, payment processors, creators, referral partners, advertisers, analytics providers, data licensors, sports data providers, rights holders, security vendors, and public sources, used only for purposes compatible with this Policy and applicable law.
3. How We Use Personal Data
- Create, authenticate, secure, and manage accounts.
- Provide feeds, profiles, game rooms, live audio and video, chats, scores, recommendations, notifications, and creator features.
- Personalize content based on teams, sports, creators, and activity.
- Process subscriptions, purchases, payouts, refunds, and tax or identity status.
- Provide contextual and first party advertising, measure ad delivery, and prevent advertising fraud.
- Attribute referrals and administer Ambassador or creator programs.
- Moderate content, enforce rules, protect minors, prevent abuse, and preserve sports integrity.
- Detect fraud, security incidents, account compromise, spam, and technical problems.
- Communicate about service, safety, billing, legal notices, promotions, and support.
- Conduct analytics, research, testing, accessibility, and product improvement.
- Establish, exercise, or defend legal claims and comply with law.
- Create aggregated or deidentified information that does not reasonably identify a person.
4. Recommendations, Ranking, and Automated Processing
FanPulse may use account preferences and activity to rank feeds, recommend games or creators, identify spam, detect rights concerns, and flag potential rule violations. Material account enforcement includes human review where reasonably available, particularly after an appeal. FanPulse does not use a solely automated decision to make a decision producing a legal or similarly significant effect unless disclosed and permitted by law.
5. How We Disclose Personal Data
- Other users and the public when you post publicly, go live, create a public profile, or interact in a public game room.
- Creators when you subscribe, follow, participate in a creator community, or purchase a creator benefit, limited to information reasonably necessary for the feature.
- Service providers handling cloud hosting, content delivery, moderation, captions, translation, analytics, security, communications, support, payments, tax, identity verification, and storage.
- Sports data, media, advertising, referral, commerce, or event partners when needed for the service and consistent with disclosed purposes.
- Professional advisers, auditors, insurers, banks, investors, and financing sources under appropriate obligations.
- Rights holders and platforms when needed to investigate infringement, unauthorized broadcasts, fraud, or safety.
- Government agencies, courts, regulators, law enforcement, or sports integrity bodies when required by law or reasonably necessary to protect rights, safety, or competition integrity.
- A buyer, successor, investor, or affiliate in a merger, financing, restructuring, bankruptcy, or asset transfer, subject to law and appropriate safeguards.
- Another party with your direction or consent.
FanPulse does not disclose private messages to other users unless a participant shares them, a safety or moderation feature requires review, or law permits or requires disclosure.
6. Advertising and Sale or Sharing
As drafted for launch, FanPulse uses contextual advertising and first party information to personalize content and advertising within FanPulse. FanPulse does not sell personal data for money and does not share personal data for cross context behavioral advertising. Before FanPulse adds third party cross context behavioral advertising or another practice treated as sale, sharing, or targeted advertising under applicable law, FanPulse must update this Policy, provide required notices and opt out controls, honor recognized universal opt out signals where required, and update the cookie interface. FanPulse does not knowingly sell or share the personal data of users under sixteen.
7. Cookies and Similar Technologies
FanPulse uses cookies, local storage, software development kits, pixels, and similar technologies as described in the Cookie Notice. Users may manage optional technologies through the cookie interface and device settings. Blocking a necessary cookie may prevent account, security, preference, or referral functions.
8. Data Retention
- Account and profile data while the account is active and for a reasonable period after deletion.
- Public content until deleted or the account is removed, subject to backups, shares, embeds, legal holds, and rights records.
- Private messages for the period needed to provide the feature, enforce rules, address reports, and meet legal obligations.
- Transaction, payout, tax, consent, and contract records generally for at least seven years where reasonably required.
- Security, moderation, and fraud records for a period based on risk, severity, appeal, and legal needs.
- Raw referral click data generally for up to eighteen months before aggregation or deletion, unless needed for an investigation.
FanPulse may retain deidentified or aggregated information and may retain data longer for litigation, law enforcement preservation, tax, accounting, security, fraud, child safety, rights, or regulatory obligations.
9. Security
FanPulse uses reasonable administrative, technical, and physical safeguards appropriate to the data and risk, which may include encryption, access controls, logging, monitoring, secure development, vendor review, and incident response. No service is completely secure. Protect your credentials and report suspected compromise to [email protected].
10. Children's Privacy
FanPulse is not directed to children under thirteen and does not knowingly collect personal data from them without legally required parental notice and consent. If FanPulse learns that an account belongs to a child under thirteen without required consent, FanPulse may delete or restrict the account and data. A parent or guardian may contact [email protected] to request review or deletion. FanPulse may take reasonable steps to verify parental authority.
11. Your Privacy Rights
Depending on residence and law, you may have rights to confirm processing and access personal data; correct inaccurate data; delete personal data, subject to exceptions; obtain a portable copy of certain data; opt out of qualifying sale, sharing, targeted advertising, or significant profiling; limit certain uses of sensitive personal data where applicable; withdraw consent where processing relies on consent; appeal a denied request; and not receive unlawful discrimination for exercising rights. 12. Texas Privacy Rights and Appeals
Texas residents may exercise applicable rights under the Texas Data Privacy and Security Act. If FanPulse denies a qualifying request, the response will explain how to appeal. Submit an appeal to [email protected]. FanPulse will respond within the legally required period and provide information about contacting the Texas Attorney General when required.
13. California Notice
If FanPulse is subject to the California Consumer Privacy Act, the categories described in this Policy include identifiers, customer records, commercial information, internet or electronic activity, geolocation, audio and visual information, professional information, inferences, and sensitive personal information where collected. California residents may have rights to know, access, correct, delete, opt out of sale or sharing, limit certain use of sensitive personal information, and receive information about categories of disclosures. FanPulse will provide a "Your Privacy Choices" link and honor Global Privacy Control if required by actual practices and law.
14. International Users
FanPulse is operated from the United States. If you use FanPulse from another country, data may be processed in the United States and other locations where service providers operate. FanPulse will use required transfer mechanisms when applicable. Users remain responsible for local content and wagering restrictions.
15. Changes
FanPulse may update this Policy. A material change will be announced through the service or email and, where required, will not apply to previously collected data for a materially different purpose without appropriate notice or consent.
