This Rights Attestation governs publishing lockable (paid) content on FanPulse, operated by Alliable Interactive LLC d/b/a FanPulse. You accept it once per version at publish time as your certification that you hold the rights you are monetizing. It supplements the Creator, Livestream & User Content Terms.
1. What You Are Attesting
By selecting I certify and accept before you lock or price content, you represent and warrant, as of publication and continuously while the content is available:
- You own the rights to this content, or hold a valid written license or permission sufficient to publish and monetize it on FanPulse.
- You have obtained all required releases for every identifiable person featured in the content, and, for any minor, from a parent or legal guardian.
- The content does not infringe any third party's copyright, trademark, publicity, or other rights, and does not rebroadcast a television, radio, streaming, school, district, league, or venue feed.
- The content does not violate any applicable league, school, conference, or sponsor policy.
- The rights class you selected is truthful: Owned (you hold the rights), Licensed (a signed licensor agreement backs it, with a revenue split), or Referenced (headline, short snippet, and outbound link only — which is never lockable or sold).
2. Referenced Content Is Never Sold
You understand that Referenced content — a headline, a short snippet, and a link out to the original source — may never be placed behind a paywall, priced, or sold on FanPulse, and that this restriction is enforced by the platform and not merely by policy. Attempting to monetize referenced material is a breach of these terms.
3. Indemnification
You will defend, indemnify, and hold harmless Alliable Interactive LLC d/b/a FanPulse and its officers, employees, and agents from and against any third-party claim, demand, damage, or expense (including reasonable attorneys' fees) arising from your content, your breach of this Attestation, or your infringement of any third party's rights. This obligation survives removal of the content and termination of your account.
4. Enforcement
A false attestation may result in immediate removal of the content, reversal of associated payouts, loss of monetization privileges, and account suspension, and does not limit any other remedy available to FanPulse or to a rights holder. FanPulse records the version of this text you signed, its SHA-256 hash, and the date and time of your certification.
5. Certification
By selecting I certify and accept you confirm each statement in Section 1 is true, you accept the Referenced-content restriction in Section 2 and the indemnification in Section 3, and you understand a false claim carries the consequences in Section 4. FanPulse records the version and time of this certification.
